Welcome to Beyond Borders, LLC (“Company,” “we,” “our,” “us”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you, the client (“you,” “your,” “Member,” or “Client”), and Beyond Borders regarding your use of our services, including but not limited to international matchmaking, lifestyle and romance tours, cultural experiences, translation support, coaching, medical tourism coordination, and related products and services (collectively, the “Services”).
By registering for our Services, purchasing a membership, attending an event, booking a tour, or otherwise engaging with Beyond Borders, you agree to be bound by these Terms. If you do not agree with any portion of these Terms, you must not use our Services.
These Terms are designed to do two things:
- Protect the Company by setting clear rules, disclaimers, and limits of liability.
- Protect You, the Client, by setting reasonable expectations, outlining your rights, and making our commitments transparent.
We encourage you to read these Terms carefully. This document is lengthy, because we want to be explicit, thorough, and transparent. It is not “fine print.” These Terms are the foundation of our professional relationship with you.
Our Pledge to You
At Beyond Borders, we understand that international matchmaking and related services are deeply personal. Our pledge is not only to provide services, but also to operate with integrity, respect, and professionalism. We want you to know what you can expect from us.
- Respect & Dignity – Every Client, regardless of gender, nationality, or background, will be treated with respect.
- Transparency – We disclose the risks, responsibilities, and limitations of our services up front.
- Professionalism – Our staff and affiliates are trained to provide high-quality services.
- Safety – While we cannot guarantee outcomes, we provide guidance to help you travel, connect, and engage as safely as possible.
- Confidentiality – We respect your privacy. Sensitive personal information will not be disclosed outside of required legal compliance and necessary service operations.
- No False Promises – We do not guarantee love, marriage, medical results, or financial outcomes. We promise effort, access, and opportunity, but not results beyond our control.
The information requested may include your name, email address, phone number, mailing address, and optional details such as age or gender.
Definitions
For clarity, the following terms are used throughout these Terms:
- “Member” or “Client” – Any individual who purchases or uses our Services.
- “Matchmaking Services” – Services related to introductions, database access, communication tools, coaching, and other relationship-related offerings.
- “Tour Services” – Travel, group tours, cultural excursions, social events, and related services offered or organized by Beyond Borders.
- “Medical Tourism Services” – Facilitation of international medical treatments, appointments, or wellness-related travel. Beyond Borders is not a healthcare provider.
- “Third-Party Providers” – Independent service providers (such as hotels, airlines, translators, drivers, medical professionals, or affiliates) who are not employees or agents of Beyond Borders.
- “Force Majeure” – Events outside of our reasonable control, such as natural disasters, wars, pandemics, strikes, or governmental restrictions.
If you no longer wish to receive promotional communications, you may unsubscribe by following the instructions in the email or updating your account preferences.
We do not sell or rent your personal information.
Eligibility & Client Representations
By registering with Beyond Borders, you represent, warrant, and agree to the following:
- 1. Age Requirement – You are at least 18 years old (21 for participation in certain tours).
- 2. Legal Capacity – You are legally capable of entering into a binding contract in your jurisdiction.
- 3. Single Status – You are single, divorced, separated, or widowed, and not currently in a legally binding marriage or domestic partnership.
- 4. Compliance with IMBRA (if applicable) – You agree to comply with the International Marriage Broker Regulation Act of 2005 (IMBRA) if your participation involves introductions between U.S. citizens and foreign nationals.
- 5. No Criminal Record – You do not have a criminal history involving violence, sexual offenses, human trafficking, fraud, or related crimes. You consent to background checks if required by law or Company policy.
- 6. Truthful Information – All personal details you provide (profile, photographs, financial status, health disclosures, etc.) are accurate and truthful to the best of your knowledge.
- 7. Financial Responsibility – You confirm you have the financial means to participate in the Services you purchase (e.g., international travel, tour fees, medical tourism arrangements).
- 8. Good Faith Participation – You agree not to misuse our Services, harass other Members, or exploit the platform for scams, solicitation, or business purposes.
Failure to meet these eligibility requirements may result in termination of membership without refund.
Scope of Services
Beyond Borders provides a wide variety of services. To avoid misunderstanding, here is a non-exhaustive description of what we do—and equally important, what we do not do.
5.1 Matchmaking Services
- Access to client profiles and introductions.
- Translation and communication support.
- Coaching, education, and relationship guidance.
- Hosting events designed to facilitate social interaction.
Limitations:
- We do not guarantee love, marriage, or compatibility.
- We do not verify every statement made by Members.
- We are not responsible for the personal conduct of Members.
5.2 Tour Services
- Organization of social events abroad.
- Cultural activities and group travel logistics.
- On-the-ground staff support.
Limitations:
- We are not a licensed travel agency; travel bookings may involve third-party providers.
- We are not responsible for weather, political unrest, or local conditions beyond our control.
- Tour itineraries may change without notice for safety or logistical reasons.
5.3 Medical Tourism Services
- Referrals and introductions to international medical providers.
- Assistance with scheduling, translation, and local logistics.
Limitations:
- Beyond Borders is not a healthcare provider and does not provide medical advice.
- All medical care is the responsibility of the licensed third-party provider.
- We do not guarantee outcomes of any medical procedures.
5.4 General Limitations
Across all Services:
- We are facilitators, not guarantors.
- Outcomes depend on third parties, personal decisions, and circumstances outside our control.
- Clients assume all risks associated with participation.
Memberships, Fees & Payments
6.1 Membership Tiers & Pricing
Beyond Borders offers different levels of membership and service packages. Each tier may include varying benefits, such as access to profiles, coaching sessions, priority introductions, or eligibility for tours. The specifics of your membership are detailed in the materials you receive at enrollment.
6.2 Payment of Fees
- All membership fees, tour deposits, medical tourism coordination fees, and other service charges must be paid in full at the time of purchase unless otherwise stated in writing.
- Payments must be made via approved methods (credit card, wire transfer, ACH, or other methods communicated to you).
- All amounts are listed and payable in U.S. Dollars (USD), unless otherwise agreed.
6.3 Non-Refundable Policy
- Unless otherwise expressly stated, all fees are non-refundable, including if you choose not to use part or all of the Services.
- Certain exceptions may apply where consumer protection laws mandate refunds.
6.4 Renewals & Auto-Billing
- Some memberships may renew automatically unless you provide written cancellation prior to the renewal date.
- You authorize Beyond Borders to charge your payment method on file for applicable renewals or installment payments.
6.5 Late or Failed Payments
- Memberships or tours may be suspended if payment is late.
- A reasonable late fee or interest may be applied to overdue balances.
- Failure to resolve payment issues may result in termination of your membership.
6.6 No Chargeback Abuse
By purchasing from Beyond Borders, you agree not to file fraudulent chargebacks. If you dispute a valid charge, we reserve the right to suspend or terminate your membership and pursue recovery of funds.
Cancellations, Refunds & Transfers
7.1 Membership Cancellations
- You may cancel a membership at any time; however, payments already made are non-refundable.
- If cancellation is requested before services are rendered, Beyond Borders may, at its discretion, issue a partial credit toward future services.
7.2 Tour Cancellations
- Deposits for tours are non-refundable.
- Cancellations made more than 90 days prior to departure may be eligible for partial credit at our discretion.
- Cancellations less than 90 days before departure are non-refundable.
7.3 Medical Tourism Cancellations
- Fees paid for medical tourism coordination are non-refundable, as significant resources are committed upon booking.
- If the provider cancels for reasons beyond your control, Beyond Borders may assist in rescheduling.
7.4 Transfers & Substitutions
- Memberships are non-transferable.
- Tour bookings may sometimes be transferred to another person, subject to approval and additional administrative fees.
7.5 Force Majeure Cancellations
If tours, services, or events are canceled due to natural disasters, government restrictions, pandemics, or other force majeure events, refunds are not guaranteed. Instead, credits may be issued toward future services.
Code of Conduct
8.1 Professional & Respectful Behavior
You agree to conduct yourself respectfully toward staff, other Members, and third parties. This includes refraining from:
- Harassment, abuse, or discrimination.
- Unwelcome sexual advances.
- Fraudulent misrepresentation or exploitation.
8.2 Zero Tolerance for Exploitation
Beyond Borders strictly prohibits using its Services for:
- Human trafficking, prostitution, or exploitation.
- Solicitation of funds, scams, or financial manipulation.
- Activities that violate U.S. or foreign laws.
8.3 Tour Conduct
During tours, you must:
- Follow all local laws.
- Respect cultural norms and customs.
- Comply with staff instructions for safety.
8.4 Consequences of Misconduct
Violations may result in:
- Immediate removal from events or tours.
- Termination of membership without refund.
- Reporting to law enforcement when required.
Confidentiality & Privacy
9.1 Use of Personal Data
We collect and process your personal data in accordance with our Privacy Policy. This includes use of information for matchmaking, coaching, medical tourism coordination, and compliance with IMBRA or other legal obligations.
9.2 Confidential Handling of Profiles
- Your profile may be shared with potential matches, translators, or affiliates for the sole purpose of matchmaking.
- Sensitive details such as financial data or medical information are never disclosed without your consent.
9.3 Communication Records
- Some communications (translation requests, coaching sessions, or introductions) may be monitored or logged for quality assurance.
- We do not sell your data to third parties for marketing.
9.4 Legal Disclosures
We may disclose personal information if required by law, regulation, subpoena, or court order.
Assumption of Risk
By engaging with Beyond Borders, you acknowledge and accept the following risks:
- Matchmaking Risks – No guarantee of romance, marriage, or personal compatibility.
- Travel Risks – International travel may involve political instability, crime, pandemics, accidents, or natural disasters.
- Medical Risks – Medical tourism involves inherent risks, including complications, misdiagnoses, and differing international healthcare standards.
- Financial Risks – You may incur expenses beyond membership or tour fees, such as travel costs, personal spending, or medical costs.
- Third-Party Risks – Beyond Borders is not liable for the actions or omissions of third-party providers.
Limitation of Liability
11.1 No Guarantees of Outcomes
Beyond Borders does not guarantee that any Member will find a romantic partner, enter into a long-term relationship, marry, or otherwise achieve personal outcomes. The Services are offered on a best-efforts basis only.
11.2 Disclaimer of Warranties
All Services are provided “as is” and “as available,” without warranties of any kind, either express or implied. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
11.3 Maximum Liability Cap
To the fullest extent permitted by law, Beyond Borders’ total liability, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you to Beyond Borders for Services in the twelve (12) months immediately preceding the claim.
11.4 Exclusion of Indirect Damages
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, emotional distress, reputational harm, or opportunity costs.
11.5 Third-Party Liability Disclaimer
Beyond Borders is not responsible for the acts or omissions of third-party providers, including but not limited to:
- Airlines, hotels, and transportation providers.
- Medical professionals, clinics, or hospitals.
- Translators, tour guides, or affiliates.
Assumption of Risk & Client Responsibilities
12.1 Voluntary Participation
By using our Services, you acknowledge that you are voluntarily participating in matchmaking, tours, or medical tourism, and that all such activities involve risks outside the control of Beyond Borders.
12.2 Health & Fitness
You are solely responsible for ensuring that you are physically, emotionally, and medically fit to participate in tours, travel, or medical services arranged through Beyond Borders.
12.3 Compliance With Laws
You agree to comply with all applicable local, state, national, and international laws, including immigration, customs, and health regulations.
12.4 Due Diligence on Matches
You acknowledge that while Beyond Borders conducts reasonable checks, you are ultimately responsible for exercising caution, judgment, and due diligence in any relationship or meeting facilitated by our Services.
12.5 Medical & Travel Insurance
We strongly recommend obtaining independent medical, travel, and accident insurance. Beyond Borders is not liable for any uninsured losses.
Indemnification
13.1 Your Agreement to Indemnify
You agree to indemnify, defend, and hold harmless Beyond Borders, its affiliates, directors, officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
- Your use or misuse of the Services.
- Your breach of these Terms.
- Your violation of any laws or third-party rights.
13.2 Scope of Indemnification
This obligation extends to claims arising in any jurisdiction, including the U.S. and any foreign country where tours, medical services, or introductions take place.
13.3 Survival
This indemnification clause shall survive termination of your membership or cessation of Services.
Termination of Services
14.1 Termination by You
You may terminate your membership at any time by written notice. Payments made remain non-refundable.
14.2 Termination by Beyond Borders
We may suspend or terminate your membership immediately, without refund, if you:
Breach these Terms.
- Engage in harassment, abuse, or misconduct.
- Commit fraud, misrepresentation, or chargeback abuse.
- Engage in conduct deemed harmful to other Members, staff, or the reputation of Beyond Borders.
14.3 Effect of Termination
- You lose access to all Services and benefits.
- Any outstanding fees remain payable.
- Confidentiality and indemnification obligations survive termination.
Dispute Resolution
15.1 Initial Resolution Efforts
The parties agree to first attempt to resolve any dispute informally through good faith negotiations.
15.2 Mandatory Mediation
If negotiations fail, disputes shall be submitted to non-binding mediation with a mutually agreed mediator located in San Antonio, Texas, USA.
15.3 Arbitration
If mediation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA).
- Venue: San Antonio, Texas.
- Language: English.
- Arbitrator’s decision: final and binding.
15.4 No Class Actions
You agree to bring disputes only in your individual capacity and not as part of any class or collective action.
15.5 Injunctive Relief
Beyond Borders may seek injunctive relief in court to protect its confidential information, intellectual property, or business operations.
Force Majeure
16.1 Events Outside Our Control
Beyond Borders shall not be liable or responsible for any failure or delay in performance arising from events beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, hurricanes, wildfires).
- Wars, civil unrest, terrorism, or political instability.
- Pandemics, epidemics, or public health emergencies.
- Strikes, labor disputes, or shortages of labor or materials.
- Government actions, restrictions, or travel bans.
- Failures of telecommunications, internet, or utilities.
16.2 Suspension of Services
In the event of a force majeure, Beyond Borders’ obligations shall be suspended for the duration of the event. We reserve the right to reschedule or cancel services as necessary.
16.3 Client Acknowledgment
By using our Services, you acknowledge that international travel and cross-border services inherently carry risks of disruption, and you accept such risks.
Governing Law & Venue
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
17.2 Venue
Any arbitration or court proceeding permitted under these Terms shall be held in San Antonio, Texas, USA. You agree to submit to the personal jurisdiction of these courts and arbitration panels.
17.3 International Clients
If you are located outside of the United States, you acknowledge and agree that U.S. law governs your use of our Services.
Modifications to Terms
18.1 Right to Modify
Beyond Borders reserves the right to update or modify these Terms at any time, in its sole discretion.
18.2 Notice of Changes
Changes will be effective immediately upon posting on our website. We may also provide notice via email or account notification where feasible.
18.3 Continued Use
Your continued use of our Services following any update constitutes acceptance of the modified Terms.
Entire Agreement
19.1 Complete Understanding
These Terms, along with any policies referenced herein (such as the Privacy Policy), constitute the entire agreement between you and Beyond Borders regarding the Services and supersede all prior agreements, understandings, or representations, whether oral or written.
19.2 No Waiver
Failure by Beyond Borders to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
19.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
